Is Congress practicing racial profiling?

Before they entered the spiritual realm, our revered
ancestors toiled in the vineyards and bequeathed to us
lifesaving forecasts and blueprints. Dr. Charshee
McIntyre, for example, warned us about an effort to
criminalize persons of African ancestry. The
criminalization of a race is designed to dehumanize a
race and qualify it for capital punishment.
More than sixty percent of federal prisoners are
Black, although the Census notes that Blacks
constitute only ten percent of the nation's
population. This is an unprecedented and horrific
statistic. Similarly, more than half of all prisoners
in the country are Black. No other country in the
world has a higher incarceration rate. This is a facet
of "Negro Removal" and "Indian Resettlement."

Penal legislation, like federal sentencing laws, is
routinely passed in this country to criminalize race
and poverty. The Congressional Black Caucus has been
Mirandized. Black ministers are enjoying the spoils of
the faith-based initiative (FBI) while Bush is
measuring our necks.

Mayor Ray Nagin and his police commissioner took it to
another level. They criminalized their Black
constituents in order to get Bush 43 to place New
Orleans under martial law and expose the city to
federal occupation in violation of the Posse Comitatus
Act. Stated differently, they exploited a racial
stereotype to cause irreparable harm to Blacks.
Appearing on CNN on September 30, the local district
attorney in New Orleans disputed any claim of anarchy.
His office had not received a single complaint or
accusation of rape. Only four homicides occurred on
the streets of New Orleans after Hurricane Katrina.
Looting and the taking of basic necessities during an
emergency, without permission, are antonyms in any
penal code.

But for the Voting Rights Act of 1965, the mayor of
New Orleans would have been unable to do any dirty
work for white supremacists like William Bennett who
practiced educational mentacide on Black children as
Secretary of the Department of Education. Bennett is
now advocating the abortion of Black babies to reduce
crime.
His advocacy of genocide is, in itself, a crime. The
First Amendment has its limits. No one is permitted to
holler fire in a theater. Judith Miller has learned
that the First Amendment refuses to quarter anonymous
sources. Janet Jackson learned that the First
Amendment is not a bra. Bennett's threat falls within
the clear and present danger test.

His pretense that it would be "morally reprehensible"
to abort Black babies is not a disclaimer under the
Constitution. In Herrera v. Texas, the Supreme Court
announced that a criminal defendant may be morally
innocent and, yet, legally guilty. In other words, law
and morality are separate and unequal terms under the
First Amendment.

Shelby Steele of the Hoover Institution has been
marched out to defend Bennett's threat. John McWhorter
of the Manhattan Institute agrees. Secretary of State
Condoleezza Rice is also a robot manufactured at this
mental cesspool. Their link is Stanford University. It
proves that dead presidents still run this country.
Like Black leaders, they are living large and are
given access to the media in order to camouflage the
fascist direction of this country. This is racial
treason. Bush 43 inappropriately describes Bennett's
terroristic threat as "inappropriate." His response is
also insufficient.

Congress passed a resolution in February 1994
condemning Khallid Muhammad's speech at Kean College
in November 1993. Led by Rev. Jesse L Jackson, Black
leaders vociferously called for his head. White
members of Congress followed suit.

For Bennett, Black leaders are standing behind Cong.
Nancy Pelosi, who, as Democratic Minority Leader, also
stripped Cong. Cynthia McKinney of her congressional
seniority, is only demanding an apology from Bennett.
John Russworm and Rev. Samuel Cornish are turning over
in their graves: "We wish to plead our own cause. Too
long have others spoken for us" (Freedom's Journal in
1827).

Welcome back to the plantation. The three-fifths
compromise of the Constitution inured to the benefit
of the Democratic Party. During Reconstruction,
northern Democrats worked out another compromise to
put southern Blacks back under the jurisdiction of
southern whites while luring northern Blacks into the
Democratic Party. Southern Blacks were absent from the
New Deal Coalition. This political equation changed in
1960.
Khallid was not an oathtaker and his citizenship
status was suspect. Nonetheless, Congress passed a
bill of attainder to call for his death. What's good
for Khallid should also be good for Bennett, who is
not only an oathtaker but also a full-blooded,
American citizen.

As an oathtaker, Bennett is receiving federal funds
monthly. In addition, Blacks are supplementing his
income. This allows him to espouse Bush 43's fascist
views. If Blacks are to be assured the right to the
equal protection of the laws, Congress has to sanction
Bennett as a deterrent for other fascists.
If Congress refuses to sanction Bennett, every Black
leader must posthumously apologize to Khallid for
allowing his alleged religious bigotry against Jews to
trump free speech. Khallid became a marked man and was
uninvited to speak at the Million Man March. His death
was suspicious. He paid for his controversial words.
So should Bennett.

Members of the New York Legislature, without any
dissent, filed a disciplinary complaint demanding the
silencing of my voice, as a legal advocate, especially
since I had the courage of continuously and
successfully defending the Black community pro bono
and pursuing Steve Pagones, an assistant district
attorney in Dutchess County, who was involved in the
kidnapping and rape of Tawana Brawley.

No white man has ever been imprisoned for raping a
Black woman. For not knowing my place and speaking
truth to power, I have been suspended from the
practice of law for fifteen years and am living in
political exile until I agree to become a racial
accommodationist.

Bennett is guilty of racial defamation and he has also
committed verbal crimes including criminal
solicitation and making terroristic threats. If Blacks
were entitled to legal representation, Bennett's name
would already appear on a civil complaint and a
criminal indictment.
Bennett must know that his forefathers were criminals
and that the Founding Fathers were kleptocrats. Their
motivation was not survival. It was greed and their
invidious acts rose to the level of crimes against
humanity. Blacks are still the victims of this
inhumanity.

We must develop a grand strategy to stop financing our
oppression and bring corporate America to its
financial knees. Black leaders must stop putting the
cart before the horse. For example, Black leaders have
threatened to tell the FCC on Bennett. Congress
created the FCC and it is accountable to Congress.

If the FCC is served with a congressional resolution
denouncing Bennett, it would automatically end his
broadcasting career. An independent, political party
is essential to voice Black grievances in Congress.
First and foremost, Blacks need critical and
knowledgeable thinkers.
