May 24, 2004, State Attorney Bernie McCabe found Pinellas county sheriff's deputies David Antolini and Nelson DeLeon justified for murdering 17-year-old Marquell McCullough on May 2, 2004.

Marquell McCullough was a victim of racial profiling, which led to him being gunned down with 15 bullets, one which ricocheted off his seat belt and penetrated the back of his head, killing him instantly.

In addition, 7 shots entered his shoulder as another bullet was found in his upper right arm.Despite the decision, there are several inconsistencies and unanswered questions that contradict why the two killer cops were justified for the assassination of Marquell McCullough.

According to the St. Petersburg Times, Bernie McCabe's investigation revealed McCullough was not the individual the police were looking for when they were investigating "possible drug activity" at the La Quinta Inn located on 4999 34th St. North. The white truck driven by McCullough did not fit the description of what Deputy John Syers was initially looking for.

The St. Petersburg Times reported that McCullough "rammed" his car into an officer. Another article stated that the white pickup truck backed into an officer - although the truck rolled forward into a ditch after McCullough was killed.

According to the two deputies, Marquell McCullough "rammed" his car into one police cruiser and then clipped another cruiser. Considering both officers walked away without any scratches or injuries, all accounts are difficult to perceive as credible.

Coincidentally, both cruiser cameras did not work. DeLeon's camera was broken, while Antolini's camera was supposedly giving him prior problems.

"We can not accept this excuse", said InPDUM International President, Sateesh Rogers. "This is similar to a student telling his teacher that he didn't complete his homework because the dog ate it."

The police committed the crime when they illegally pulled him over, using the tint on his windows as an excuse to see if he had drugs in his vehicle.
